By using Pop.com.au, you are deemed to have read and agreed to the following terms and conditions: The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Visitor", "You" and "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions. "The Company", "Ourselves", "We" and "Us", refers to our Company (WW E-Services Australia Pty Ltd, L12/201 Kent Street, Sydney NSW 2000). "Party", "Parties", or "Us", refers to both the Visitor and ourselves, or either the Visitor or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Pop provides its members with exclusive offers on awesome design products. We require you to create an account to make a purchase. Click Here to see our Refund Policy. Some offers have conditions that are specifically related to a given offer. Making a purchase is acceptance that all specific conditions have been read and understood. Neither Pop nor the supplier is responsible for lost or stolen items after delivery has been made. In the event a voucher is issued, it is deemed void at any point after the expiration date listed on the Offers.

Unless otherwise stated orders will be delivered during normal business hours between 8am and 5pm and need to be signed for. It is a good idea to enter a delivery address at which someone will be present to accept the goods at this time; for example your workplace. If there is no one present at the delivery location who is entitled to accept and sign for the delivery, a card will be left in your letterbox informing you about the incomplete delivery and where to pick your parcels up. Parcels will usually be available for pick up at your nearest Post Office for 7 days unless you are informed otherwise.
In cases where the parcel is not picked up or has an incorrect delivery address, the item will be returned to Pop. We will attempt redelivery once the delivery address has been confirmed, subject to a redelivery fee, or else pay a credit refund on returned items. We do not provide bank refunds on returned items or postage costs of returned items.
If the product has been damaged in transfer, please inform Pop immediately and provide pictures if possible.
In cases where you have provided authority to leave a parcel without your signature, Pop shall not be liable for any direct or indirect loss or damage caused. Pop absolves all risk from the point that the parcel/s arrive at your nominated delivery address.
The Australian Consumer Law ("Law") which forms part of the Competition and Consumer Act 2010 (Cth) implies into consumer contracts certain statutory conditions and warranties that cannot be excluded, restricted or modified. These are in addition to any voluntary warranties offered by the manufacturer or supplier. Where there is a breach of such a warranty relating to goods or services, and the breach is in terms of the Law, a "major" failure, then the remedy will be limited to a refund, repair or replacement (subject to availability) at your election.
Pop vouchers (including but not limited to; hard-copy and/or digital gift or promotional vouchers, promotional codes, credits) are personal to the Member receiving them.
Pop vouchers are not transferable, have no monetary value and under no circumstances can they be converted into currency. The use of a Pop Voucher requires the total value of the order to be higher than the monetary value of the discount given by a Pop Voucher/s.
Pop reserves the right to specify a minimum spend for which Pop Vouchers are permitted to be used. In this case, the monetary value of the order (excluding delivery costs) has to be higher than the minimum spent. Only 1 Pop Voucher can be used per member per sales event. Pop reserves the right to cancel Vouchers if they were improperly obtained, including but not limited to violation of the Pop Terms and Conditions.
Pop “Invite your Friend” Vouchers are valid for 3 months after they are first credited to a Member’s account. Promotional or competition vouchers are valid for 3 months unless otherwise stated. New member signup vouchers are valid for 1 month after signing up.
In addition to the above, if you purchase or receive a Gift Card from Pop or a third-party recipient, the value on the Gift Card will be added as Pop credit on the recipient's account. If the recipient does not have an account, the recipient must register an account before the credit is applied. There is no requirement for a minimum spend when using these specific credits and the credits may be applied towards multiple purchases. Printed or hard copy Gift Cards will expire in accordance with the date provided on the Gift Card whereas digital Gift Cards (whereby Pop generates the Gift Card digitally and sends it to the member's email address) will be valid for 12 months from the purchase date of the digital Gift Card.
In order to apply the credit from a Voucher or Gift Card (digital or hard copy) members will be prohibited from using any additional promotional discounts, credits, promotional codes or credits from additional gift cards (hard copy or digital).
Promotional codes and existing credits cannot in any circumstances be used to purchase gift vouchers in full or as part-payment.
Exclusions and Limitations
The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Company: excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company's literature; and excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. This Company does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
Use and Access
You are solely responsible for evaluating the integrity and accuracy of any text and content available through this site. Pop.com.au shall not be held liable for untimely removal of inappropriate, damaging, or offensive content. Redistribution or republication of any part of this site or its content is strictly prohibited, including such by framing, screen scraping, other similar or any other means, without the express written consent of the Company. Pop.com.au does not claim that the service from this site will be uninterrupted, timely or error free, although it is provided to the best of our ability. By using this service you thereby indemnify this Company, its employees, agents, officers, and affiliates against any loss or damage, in whatever manner, howsoever caused.
We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers may log standard access information including browser type, access times/open mail, URL requested, and referral URL.

Notification of Changes
We may modify our terms and conditions without notice at any time where such amendment does not substantially effect your rights and obligations. If such changes of our terms and conditions substantially effect your rights and obligations we will notify you by email with these changes as they occur.
We may restrict sales quantities to each member to normal household quantities in order to enable all of our members to have a chance of purchasing the products they desire.
In an effort to prevent fraudulent use of credit cards or other payment options, we will make reasonable efforts to validate the legitimacy of the order and/or the cardholder’s identity, which may include requesting proof of identity. However, we do not guarantee that we can prevent the fraudulent use of such information by unauthorised third parties. In instances of high value orders being placed and/or where we suspect your card may be at risk of fraudulent use, we will follow internal company procedures to confirm the order is bona fide. Where we cannot reasonably rule out fraudulent card use prior to processing your order, we may decide to cancel the order (notifying you via email).
